Copyright infringement only really matters, at least to Americans [Orch. Stab], when there's money involved. Harsh Patel credits the artist, and that's ultimately the most important thing here. IMO.
I think what's worse is being on set and having a creative director show you six reference images from the same photographer and asking you to "Shoot it to look like this." Believe it or not kids, it happens every single day in commercial, fashion and all things in between photography.
I think there was a discussion about this before though, emulation vs. inspiration?
And I think Lucluc has it on the spot. Albeit nowadays it's easier to track people ripping people off, it's also easier to rip people off and get away with it.
